End User License Agreement

 

BY USING ECTAS, YOU AGREE THAT:

  1. You have been designated by an authorized health care provider (the “Provider”) as an authorized “Permitted User” to use the Application known as the “Application” in connection with the [<Program>] (the “Program”). As a Permitted User, you may use the Application in the manner and for the uses as directed by your Provider.
  2. You are using the Application solely for the purpose as described above and for no other purpose whatsoever, and will use the Application in accordance with the Website Terms and Conditions of Use (located at [https://[<*>].on.ca]), and any and all policies and guidelines that may be provided by CCO from time to time.
  3. Your Provider has signed a license agreement relating to the Program, which dictates the use of the Application by your Provider and each Permitted User designated by your Provider, including you.  It is your responsibility to become familiar with such terms and conditions.  Further, you agree: (i) not to share or disclose your password to any other person; (ii) not to access the Application with another person’s Authentication ID and password; (iii) you are responsible for the accuracy and completeness and adequacy of the data that you submit to the Application; (iv) not to use the Application to access or obtain Personal Information or Personal Health Information of any individual for whom you do not have permission to access or obtain; (v) not to reverse engineer any reports or other data accessed by the Application; (vi) that you, or your Provider, shall be responsible for procuring and operating such equipment necessary to access and use the Application environment; (vii) not to copy[A1] , reverse engineer, decompile, disassemble, translate, change or otherwise attempt to view, display or print the source code to the Application; and (viii) to comply, at all times, with all applicable legal and regulatory requirements and with CCO’s security and privacy policies in respect of the use of and access to the Application.
  4. Any fraudulent, abusive, or otherwise illegal activity or any use of the Authentication ID’s and passwords, accounts, or the Application in contravention of the applicable license agreement and this End User License Agreement, shall be grounds for termination of your Authentication ID, at CCO’s sole discretion and without liability to you.
  5. You acknowledge that certain information disclosed to you pursuant to your use of the Application may constitute “personal health information” pursuant to the Personal Health Information Protection Act, 2004, S.O. 2004, c.3, as amended, (“PHIPA”) and may be regulated by PHIPA and other applicable law.  You agree to use such information only for those purposes permitted under PHIPA and to limit your disclosure of it only to those persons designated by your Provider.  You additionally agree not to use the Application to access or obtain any information of any individual from whom you do not have permission to access or obtain such information.
  6. You acknowledge and agree that CCO owns all rights title and interests and all intellectual property rights in and to intellectual property that may exist in and to the Application, the Authentication IDs, accounts and any other documentation provided to you by CCO. You do not acquire any rights, title or ownership interests of any kind whatsoever, express or implied, in any of the foregoing, other than the right to use such materials in accordance with the terms herein. You further acknowledge that all of CCO’s obligations and liabilities in respect of any use of the Application are contained in this Agreement.
  7. CCO does not provide and there are no express or implied warranties or conditions in relation to the Application, including implied warranties or conditions of merchantable quality, fitness for a particular purpose, or non-infringement, or that any of the foregoing will meet your or your Provider needs or will be available for use at any particular time or will be error free.  CCO may provide help desk services in relation to the use of the Application.  However, due to possible resource limitations, CCO does not warrant and hereby disclaims that the help desk will be available at any particular time or that any particular request for assistance will be responded to or resolved within any particular timeframe.
